Position Overview:
The incumbent will be responsible for counseling the company on legal risk and representing its interests in all types of litigation, administrative actions and investigations, as well as responding to subpoenas and government requests for information.
In particular, the incumbent will be responsible for advising the company’s Multifamily business and legal colleagues on litigation risks in connection with the origination, purchase and securitization of Multifamily loans.

In your role as an attorney in the Litigation Department, you will:
Represent the organization in federal and state courts, administrative actions, and similar proceedings
Actively manage outside counsel and drive case strategy
Provide sophisticated advice to internal clients regarding legal and litigation risks arising from the company’s business; regarding our Multifamily business, you will provide advice regarding (among other things):
potential restrictions on business with counterparties and third parties, and
the company’s investigations into potential breaches of legal and contractual obligations in connection with the origination or servicing of Multifamily loans
Manage internal and/or external investigations as needed
Conduct legal research as needed
Work with the eDiscovery and ESI Management Team on various eDiscovery, document preservation and production matters
Respond to third-party subpoenas and government requests for information and documents
Understand the organizations business, particularly its Multifamily Seller/Servicer Guide (including knowledge of the representations, warranties, covenants and legal remedies) and other contracts
Perform other duties as assigned
Qualifications:
Juris Doctor (JD) degree
Membership in good standing in a state Bar
Typically 12+ years relevant litigation experience with a top tier law firm or in-house at a bank, financial or other institution with a sophisticated real estate and investment portfolio
Significant experience with all aspects of litigation, including arguing motions, conducting depositions, large case discovery and document productions, brief writing, pre-trial activities, and trials
Significant experience counseling senior business clients on a wide variety of litigation and legal risk issues
Significant experience conducting and advising on investigations, including interactions with law enforcement agencies
Significant experience with all aspects of the origination, purchase and securitization of Multifamily loans
Excellent analytical, strategic, legal research, writing and advocacy skills
Strong eDiscovery experience
